Receitas médicas e odontológicas poderão ter validade nacional
Receitas médicas e odontológicas devem ter validade nacional, como previsto em projeto (PLS 325/2012) aprovado pela Comissão de Assuntos Sociais (CAS) nesta quarta-feira (6). Isso significa que um medicamento prescrito por um profissional habilitado poderá ser comprado em qualquer localidade do país, independentemente do local de origem da receita.
Atualmente, as receitas são reconhecidas e aceitas apenas dentro do estado onde foram emitidas. Para o autor da proposta, senador Jayme Campos (DEM-MT), a ampliação da validade para todo o território nacional evitará transtornos e riscos hoje enfrentados pelos pacientes, assegurando a continuidade do tratamento onde quer que se encontrem.
A proposta recebeu decisão terminativa e deverá agora seguir diretamente para a Câmara dos Deputados, a menos que seja apresentado recurso para decisão final em plenário.
Como o texto original só tratava das receitas médicas, a relatora, senadora Ana Amélia (PP-RS), sugeriu uma emenda para garantir validade nacional também às receitas odontológicas.
Jayme campos reconhece a necessidade de mecanismos de controle na comercialização de medicamentos, a fim de impedir irregularidades, como automedicação e contrabando. Porém, classificou de “contrassenso” a proibição de venda em localidade diferente daquela em que foi feita a emissão, já que o profissional devidamente registrado dispõe do direito legal de atuar em qualquer parte do país.
Ao defender a proposta, Ana Amélia (PP-RS) relatou que ela mesma já havia se deparado com dificuldades por causa da atual restrição. Isso porque se viu impedida de adquirir em Brasília medicamento prescrito por um médico de Porto Alegre, a capital de seu estado.
Os senadores Humberto Costa (PT-PE) e Paulo Davim (PT-RS), que são médicos, também se manifestaram a favor da proposta. Para Costa, os ministérios da Saúde e da Justiça poderão criar regulamento para afastar qualquer tipo de preocupação com a validade nacional de medicamentos controlados.
Para Davim, a proposta é de extrema conveniência para a saúde pública. Na situação atual, observou, restam apenas duas alternativas para o paciente que ficar sem remédio em outro estado, mesmo dispondo da receita: ou não toma o remédio ou terá de procurar uma unidade pública de saúde, normalmente cheia de gente, em busca de nova receita.
– O projeto é também um meio para desonerar as unidades públicas de saúde – concluiu Davim.
